Spanish treasure lands after 200 years

MADRID (Reuters) - Coins worth nearly half a billion dollars finally arrived in Spain on Saturday after lying in a sunken warship for more than 200 years and following a five-year legal battle between the Spanish government and a salvage company.

The Nuestra Senora de las Mercedes, a 49-gun navy frigate, set sail from the coast of Peru - then a colony of Spain - with coins to help replenish the Spanish treasury's coffers.

In 1804, British warships attacked as the frigate was approaching the Spanish port of Cadiz and the ship went down, with 249 killed, a Spanish government website said.

On Saturday, Spanish military aircraft landed at the Torrejon air force base near Madrid bearing 594,000 gold and silver coins recovered from the wreck by U.S.-based Odyssey Marine Exploration in 2007.

Spain had argued in court that it, not the salvage company, was the rightful owner of the cargo and the ship, and a U.S. judge ordered on February 17 that the coins be returned from Florida.

The company said it would abide by the ruling, although a spokeswoman said it "flies in the face of all legal precedent.

"This a victory for Spain and the United States," lawyer Jose Maria Lancho, who advised the Spanish government in its action against Odyssey, told Reuters.

"For Spain, this sunken ship, this archaeological site, is still a warship and we still have jurisdiction over what has happened to it."

The Spanish government plans to restore, conserve and catalogue the contents of the 17-tonne cargo, which it estimates to be worth 373 million euros ($496 million).

Several cities are vying to put the coins on show, but the culture minister said no decision had yet been taken. Spain has not said where it will keep the coins in the meantime, for security reasons.

While the treasure is now in Spain, there is still legal action pending.

Spanish news agency EFE reported the Peruvian government planned to appeal to the U.S. Supreme Court to claim part of the cargo.

And Malaga-based marine archaeology company Nerea, which Lancho also works with, has been asking a Spanish court to bring charges against Odyssey of damage to cultural heritage, damage to archaeological sites and trafficking in archaeological heritage.

Local media citing Spanish government sources reported part of the ship's cargo was still in Gibraltar, a British-administered territory in southern Spain whose sovereignty is disputed by the Spanish government.

"We are in touch with the Spanish Ministry of Foreign Affairs. As yet, we do not have any confirmation that any of the ship's contents are in Gibraltar," a British Embassy spokesman said in Madrid.

Updated at?5:36 p.m. ET: A gunman shot dead two American military officials inside the heavily guarded Afghan Interior Ministry in the center of the capital Kabul on Saturday in an alarmingly brazen attack, as protests raged across the country for a fifth day over the burning of the Muslim holy book at a NATO base.

The Americans, who were U.S.?Army officers serving as advisers to the Afghan security forces, were sitting at their desks inside the government ministry building when they were killed, NBC News reported. They were shot in the back of the head, Western officials speaking on condition of anonymity told The Associated Press.

U.S. officials said the assailant ? who has not been identified by name or nationality ? remained at large and a manhunt was under way.

Underscoring the gravity of the attack and apparent security breach, Gen. John Allen, the commander of NATO and U.S. forces in Afghanistan,?ordered all NATO personnel recalled from Afghan ministries "for obvious force protection reasons."

"There is CCTV there and special locks. The killer would have had to have the highest security (clearance) to get to the room where they were killed,"?an Afghan security source told Reuters.

NATO spokesman Lt. Col Jimmie Cummings said "initial reports say it was not a Western shooter." He declined to provide further information.

In an e-mail sent to Western officials in Kabul from NATO headquarters, the?attack was described as ?green on blue,? which is the military term used here when Afghan security forces turn their weapons on their Western military allies, The New York Times reported.

The Afghan Taliban claimed that two of their fighters had managed to enter the building in Kabul and kill four "high-ranking U.S. advisers," according to NBC News. U.S. military officials confirmed only two deaths and the Taliban claim could not be independently verified. The Taliban often exaggerate claims of responsibility for terror attacks.

"Our suicide bomber Abdur Rahman along with another fighter managed to enter the interior ministry and open fire at the Americans. In Washington,?Pentagon press secretary George Little?said Defense Secretary Leon Panetta was informed of the shooting Saturday morning. "This act is unacceptable, and the United States condemns it in the strongest possible terms," Little said.

He said?Afghan Defense Minister?Gen. Abdul Rahim Wardak called Panetta to apologize and to offer his condolences.

"Secretary Panetta appreciated the call and urged the Afghan government to take decisive action to protect coalition forces and curtail the violence in Afghanistan after a challenging week in the country," Little's statement said. "Minister Wardak said that President (Hamid) Karzai was assembling the religious leaders, parliamentarians, justices of the Supreme Court and other senior Afghan officials to take urgent steps to do so."

In Kabul, Allen met with Afghan Interior Minister?Bismillah Mohammadi, who pledged "complete cooperation in investigating today's tragedy and in taking stronger measures to protect ISAF personnel," Little said.

President Barack Obama called Allen after Saturday's shootings and the White House said the president supported the steps taken to protect U.S. service members in Afghanistan.

"We welcome President Karzai's statement ... encouraging peaceful expressions, and his call for dialogue and calm. The United States remains committed to a partnership with the government and people of Afghanistan, as we work to realize our shared goal of disrupting, dismantling and defeating al-Qaida and strengthening the Afghan state," the White House statement added.

If the shootings are linked to Afghan forces, new questions will arise about Taliban infiltration as well as their ability to secure Afghanistan once NATO combat forces withdraw in 2014.

NATO is supposed to be moving away from a combat role to an advise-and-assist mission as early as next year. That will require NATO to place more staff in ministries.

"The fact that NATO is recalling staff from ministries suggests they are worried about a deep malaise in the Afghan security forces, that they expect more of these attacks," said Kamran Bokhari at STRATFOR global intelligence firm.

At least 28 people have been killed and hundreds wounded since Tuesday, when it first emerged that Qurans and other religious materials had been thrown into a fire pit used to burn garbage at Bagram Air Field, a large U.S. base north of Kabul. Among those dead were two U.S. soldiers who were killed Thursday by one of their Afghan counterparts while a riot raged outside their base in the eastern province of Nangarhar.

President Barack Obama and other U.S. officials apologized and said the burning of Qurans was a terrible mistake, but the incident has sent thousands to the streets in this deeply religious country.

In Kunduz, the capital of Kunduz province in northeast Afghanistan, more than 1,000 protesters demonstrated. At first they were peaceful, but as the protest continued they began throwing stones at government buildings and a U.N. office, said Sarwer Hussaini, a spokesman for the provincial police. He said the police were firing into the air to try to disperse the crowd.

The U.N. confirmed in a statement that its Kunduz compound was attacked, but said all its staff in Kunduz and in the country were unhurt and accounted for. The statement thanked Afghan security forces for their quick response to the assault.

That brings me to the latest scandal to emerge from the debate over global warming. Two weeks ago, an anonymous source distributed internal documents from the Heartland Institute, a conservative organization, to journalists and bloggers. ?One way or the other, Gleick?s use of deception in pursuit of his cause after years of calling out climate deception has destroyed his credibility and harmed others. (Some of the released documents contain information about Heartland employees that has no bearing on the climate fight.) That is his personal tragedy and shame (and I?m sure devastating for his colleagues, friends and family). The broader tragedy is that his decision to go to such extremes in his fight with Heartland has greatly set back any prospects of the country having the ?rational public debate? that he wrote?correctly?is so desperately needed.?

Another blogger, Joe Romm of Climate Progress, granted that Gleick ?committed a?serious lapse of professional judgment and ethics. He is right to regret his actions and make a personal apology.? But Romm went on to demand that Revkin apologize for quoting global-warming sources who, according to Romm, have ?been repeatedly debunked, the disinformers and confusionists.? Romm is referring not to deniers but to believers?such as Roger Pielke, a respected scientist?who do not accept the most extreme climate-change scenarios and solutions. To my mind, Romm is faulting Revkin?who is one of the most knowledgeable, conscientious, hard-working journalists I know?for doing his job well.

Gleick himself sounded contrite. He put it this way: ?My judgment was blinded by my frustration with the ongoing efforts?often anonymous, well-funded, and coordinated?to attack climate science and scientists and prevent this debate, and by the lack of transparency of the organizations involved. Nevertheless I deeply regret my own actions in this case. I offer my personal apologies to all those affected.?

Kant said that when judging the morality of an act, we must weigh the intentions of the actor. Was he acting selfishly, to benefit himself, or selflessly, to help others? By this criterion, Gleick?s lie was clearly moral, because he was defending a cause that he passionately views as righteous. Gleick, you might say, is a hero comparable to Daniel Ellsberg, the military analyst who in 1971 stole and released documents that revealed that U.S. officials lied to justify the war in Vietnam.

But another philosopher my students and I are reading, the utilitarian John Stuart Mill, said that judging acts according to intentions is not enough. We also have to look at consequences. Microsoft says Office for iPad story is based on 'inaccurate rumors and speculation' (updated)

The Daily got a lot of folks hopes up earlier today with a rumor that Office would soon be making an appearance on the iPad, but Microsoft is now throwing a bit of cold water on that news. While it's not exactly an outright denial that such an app is coming, a Microsoft spokesperson has now told The New York Times' Bits website that "The Daily story is based on inaccurate rumors and speculation," adding only that it has "no further comment" at this time. ZDNet's Mary Jo Foley, however, is further reporting that Microsoft is specifically saying that the screenshot accompanying The Daily's story is not a real picture of a Microsoft product.

Update: For its part, The Daily is standing by its story. Editor Peter Ha posted a reply to Foley on Twitter, stating that "we did not fabricate either image. A working version of the app was demoed to us by someone at Microsoft."

Update 2: Microsoft has chimed in yet again on the matter, this time in the form of a tweet that reads: "Great respect for The Daily but regrettably someone is giving them bad info, and that'll be clear in the 'coming weeks.'" Yes, they put "coming weeks" in quotes themselves.

The Ultimate Guide to Bond Investing

Corporate and municipal bond investing has one major problem: When interest rates go up, bonds go down.

Actually, bond investing has two major problems. The second is that people are rate pigs. They always go for the highest payout on bonds and bond funds and ignore the problems associated with long maturities.

The result is that when bonds do drop in value, which they will do at some point, the drop is accelerated by ?rate pigitis? ? really accelerated. Long maturities drop in value a lot more than short ones.

So, a bond investor has to make a choice:

• Go with really long maturities, get higher yields and suffer through the sell-off when rates go back up?

Or:

• Go for shorter maturities and put up with lower returns, but a much smaller drop in value when the sell-off finally happens?

Of course, there are those who think, ?I?ll just wait it out and collect my interest, ignore the big drop in long maturity bonds and collect my principal at maturity.?

Right! And Obama will suddenly develop a sense of business and economics and stop jerking everyone?s chain.

The Real Truth

Here?s the real truth about the average small-bond investor.

The combination of ?rate pigitis? and being completely unable to wait out a sell-off in any market ? not the just the bond market ? have turned one of the safest investments, bonds, into what will be one of the biggest money losers in the history of the markets. Treasuries included.

In the past few years, rates have settled where I have never seen them in my lifetime. Meanwhile, small investors have been standing in line to pour their money into bonds of all kinds in the hope of escaping the stock market volatility and getting some kind of return on their money. I can understand why? It?s been 10 years since we made a dime on stocks.

All of this money is going into bonds at exactly the wrong time, in all the wrong ways and at prices so high, they have to come down.

It will be a blood bath of biblical proportions when almost everyone cuts and runs as prices drop.

The Staggered Approach to Bond Investing

But this is completely avoidable. There?s a way to own bonds now and get around this impending bloodbath, and still beat the stock market.

In fact, if you use a staggered approach to bonds, rather than the usual ladder, you can:

• Get very high rates of returns.
• Minimize the drop in value when interest rates rise.
• Take advantage of higher rates and the bargains they present in a down bond market.
• And still sleep at night, too?

I know, too good to be true, right?

But this isn?t a guarantee of any kind, you will have some losses ? very few, but some. Based on today?s market averages about one to three out of a 100 trades will be losers.

Sounds good, doesn?t it?

And, you will have to follow all the rules! Yes, rules of the road that cannot be ignored. Any Navy folks out there know what that implies. Standing Orders and all!

Right off the bat, that eliminates about 25% of all investors, big and small. That bottom 25% is doomed by the fact that they don?t know what to believe and are so inexperienced they can?t separate the good information from the garbage.

Another 25% will only play the ?swing for the fence? game in the stock market. They will figure it out eventually, but not until they have lost so much they go back to CDs and money markets. At least they aren?t losing anymore.

Another 25% know they have the secret to success and will only buy stocks, because they know the secret, right?

So that leaves you and me and few other survivors who are able to see a real opportunity.

Here it is! It?s called a ?staggered bond portfolio.? Your broker will tell you it can?t work, but I have been proving him wrong for a long time.

Forget Everything You Know

First, forget everything you know about corporate bonds, and munis for that matter, especially how to structure a portfolio of them.

Think in terms of very small bond positions, as few as one bond per position, five or more is preferable, but you can do one. I know brokers will tell you it is impossible to buy less than 10 or 20 bonds. Baloney! Get another broker who knows something about bonds!

The Rules of the Road

• Buy many bonds of almost all credit qualities, as low as CCC. Right now, I prefer to stay in the BBB to CCC range, but the skittish can go for the higher ratings if you need them to sleep at night. But the BBB to B ratings don?t have that much more risk and the slightly lower-rated bonds are where all the money is.

• Buy bonds in many industries. Don?t load up on a few tech names or familiar names. Stay diversified just as in a stock portfolio.

• In the current market, shoot for an average maturity of five years or less. That means you can buy a few really good ones at seven years and a few that don?t look as good in the one- to two-year maturity. Then fill in the blanks.

As the market shifts to higher interest rates, this strategy will shift to longer maturities and the higher rates that come with them. But for now, you must stay very short on time. This market requires it.

• Never load up on a single bond because you like the return. This is the biggest trap and the biggest money burner in the business. Just ask the folks who bought Lehman Bros. bonds, AAA at the time, because they had a great interest rate and a really good rating.

For the average person, that?s someone who isn?t managing millions, there?s never a good enough reason to buy more than 10 bonds in any one position.

Plan on buying lots of different bonds so when the bad news does hit (and it will eventually), it only affects about one to four bonds out of a 100, and you don?t have your whole life hung out to dry in one position. I?ll bet you can guess which bonds will get you into trouble. Here?s a hint, it won?t be the small positions in your portfolio.

• Look for bonds whose underlying companies just had some bad news; missed earnings, bad product, lawsuit, etc. It will kill the stock and the bond will slip, too, but here?s where the difference between stocks and corporate bonds really shines.

The only question you need to ask yourself about that bond is, ?Will the company be in business when this bond matures?? The answer in almost 99% of cases is, ?Yes.?

That?s it! Let the stockholders die on the vine as this thing gets pummeled. You buy the bond while it?s down, collect the interest and capital gains, wait for the bond to go back up in value ? which they do in most cases ? then sell it or wait for maturity and collect your principal and interest.

Two More Advantages

There are two more advantages to this short staggered portfolio. Take a look at the example below of what a portion of a complete staggered portfolio looks like.

Notice you have several bonds coming due each year. This is key to this strategy. This allows you to buy back into the market at higher rates several times a year. This gives you all kinds of flexibility that laddering doesn?t.

In a traditional laddered portfolio, you have to wait several years for a bond to mature to be able to buy another. That can hurt in a fast changing bond market, which is what I?m expecting in the next few years.

Maybe the most beneficial aspect of the staggered strategy is you can see the horizon. You can see that there?s money coming due, and you know you will get your principal back, and that gives you a psychological advantage over all other types of investments.

Being able to see that horizon ? I call it the light at the end of the tunnel ? makes it that much easier to sit tight and wait out the worst that any market has to offer.

You have to be there at the end of the race to have any chance of being a winner.

That?s how you avoid the bloodbath that?s coming in the bond market, reduce your risk, avoid the volatility of the stock and make real money in bonds.

Xi stresses respect, cooperation in U.S. relations (Reuters)

WASHINGTON (Reuters) ? China's Vice President Xi Jinping on Wednesday offered deeper cooperation with the United States on trade and hot spots like North Korea and Iran, but warned Washington to heed Beijing's demands on Tibet, Taiwan and other contentious issues.

"Sino-U.S. relations stand at a new historic starting point," China's expected next leader told U.S. business groups after meetings on Tuesday with President Barack Obama and other top U.S. officials.

China and the United States should strive to create "a new type of great power relationship for the 21st century," Xi said.

But he said the two powers also had to "strive to avoid misunderstandings and avert misjudgments" and should "truly respect each other's core interests and major concerns."

Xi's visit to United States this week presents a chance for him to boost his international standing before his expected promotion to head of China's communist party later this year and president of the world's most populous nation in 2013.

Even as Xi continued his U.S. visit, Obama, at a campaign-style stop in Milwaukee, took aim at China's trade practices, saying he will not stand idly by when American's competitors "don't play by the rules."

"I directed my administration to create a Trade Enforcement Unit with one job: investigating unfair trade practices in countries like China," Obama told factory workers.

Xi met with House of Representatives Speaker John Boehner and Senate Majority Harry Reid on Wednesday morning and after his speech was headed to Iowa for the next leg of his trip, which finishes later this week in Los Angeles.

Xi addressed a number of sore spots in the U.S.-China relationship, including Beijing's currency policy.

Xi said currency reforms already taken by Beijing helped boost U.S. exports to China to more than $100 billion in 2011 and has significantly reduced China's overall trade surplus.

"China has become the United States' fastest growing export market," Xi said. "The trade surplus as a proportion of GDP has been falling from over seven percent to two percent, at a level internationally recognized as reasonable."

U.S. Treasury Secretary Geithner acknowledged on Wednesday that Beijing is gradually letting its currency rise, but not fast enough to please the United States.

"We think they have some ways to go, we would like them to move more quickly," he told a congressional panel.

SHARED CHALLENGES

Xi is poised to become China's next leader following a decade in which it has risen to become the world's second largest economy while the United States has fought two wars and endured the deepest and longest recession since the Great Depression that sapped its resources.

"The world is currently undergoing profound changes, and China and the United States face shared challenges and shared responsibilities in international affairs," Xi said.

"We should further use bilateral and multilateral mechanisms to enhance coordination between China and the United States on hotspots, including developments on the Korean peninsula and the Iran nuclear issue," he said.

At the same time, he urged Washington not to support movements in Taiwan and Tibet for independence.

China deems the self-ruled island of Taiwan to be an illegitimate breakaway from mainland rule since 1949, and has warned that the island must accept eventual reunification.

In recent years, tensions between the two sides of the Taiwan Strait have eased as economic flows have grown. But Beijing remains wary of U.S. involvement in the issue, which it calls an internal affair.

In early 2010, the Obama administrations decision to move forward with proposed arms sales to Taiwan triggered vehement criticism from Beijing, including warnings of sanctions against U.S. companies involved in the sales. Those warnings petered out, but Xi made clear that Taiwan remains an acute concern for Beijing's dealings with Washington.

Tensions over Chinese control of Tibet have flared in past months when a succession of protests and self-immolations have exposed volatile discontent. Chinese officials have repeatedly blamed those tensions on separatists or supporters of the Dalai Lama, the exiled Buddhist leader of the region.

Xi also acknowledged the Obama administration's recent "pivot" toward Asia, but warned it not to push too far.

"China welcomes the United States playing a constructive role in promoting the peace, stability and prosperity of the Asia-Pacific region, and at the same time we hope the U.S. side will truly respect the interests and concerns of countries in the region, including China."

Researchers of the Max Delbr?ck Center for Molecular Medicine (MDC) Berlin-Buch have now identified and described a molecular mechanism underlying the most common malformation of the brain in humans. In holoprosencephaly (HPE), the forebrain (prosencephalon) is only incompletely formed. Here a binding site (receptor) for cholesterol plays a key role. If this receptor is defective, specific signals cannot be received, and the forebrain cannot separate into two hemispheres, as Dr. Annabel Christ, Professor Thomas Willnow and Dr. Annette Hammes have now shown in mice (Developmental Cell, DOI 10.1016/j.devcel.2011.11.023)*.

Cholesterol has a bad reputation because it may lead to vascular calcification in adults (atherosclerosis) as well as to heart attacks and strokes. However, cholesterol is vital for embryonic development because it controls the development of the central nervous system. The lack of it can lead to severe developmental disorders of the forebrain (prosencephalon), the largest region of the human brain. One in 250 pregnancies does not come to term due to this malformation called holoprosencephaly (HPE). One in 16000 children is born with HPE, of which the mildest form is cleft lip and palate. In severe forms of HPE the affected children do not survive the first weeks of life.

HPE may be due to genetic factors, but environmental factors such as viral infections or alcohol abuse during pregnancy may also cause the malformation. Moreover, the cholesterol metabolism is also frequently disturbed. Thus, patients whose bodies cannot produce cholesterol due to a genetic disorder inevitably have HPE.

As Professor Willnow explained, the human brain develops from the neural tube, a simple tube-like cluster of cells in the embryo. Why defects in cholesterol metabolism lead to a developmental disorder of the neural tube and to HPE is thus far not completely understood. The studies of the Berlin researchers may give a possible clue. They identified a receptor called LRP2 that is formed in the neural tube and can bind lipoproteins, which are the transport form of cholesterol.

Interestingly, this receptor also binds an important signal molecule of forebrain development (sonic hedgehog, abbreviated SHH). As the researchers demonstrated, this lipoprotein receptor drives the accumulation of SHH in the neural tube at a specific site and induces the development of the forebrain structures. The researchers now suspect that cholesterol ? directly or indirectly ? plays a central role in controlling the activity of this novel receptor and assume that disturbances in cholesterol metabolism lead to a loss of function of this auxiliary receptor for SHH signaling.

The Ghostbusters retired a long time ago, after a 1984 hit film, 1989 sequel, and two animated TV shows. But?their spirit is still haunting the entertainment world.

In a webcast with Empire magazine, former Ghostbuster Dan Aykroyd implied he and co-star Rick Moranis were actively working to bring "Ghostbusters 3" to theaters sometime in the next few years.

"If we can get the script to 'Ghostbusters 3' right, then it would definitely have Moranis as a major component. None of us would want to do the movie without having him as a participant,? said Aykroyd.

?He also responded to questions that another star, Bill Murray, wasn?t into the idea, denying reports that Murray actually shredded?a potential?script?and included the note?note, ?No one wants to pay money to see fat, old men chasing ghosts.?

Replied Aykroyd, ?Bill Murray is not capable of such behavior. This is simply something that would not be in his nature. We have a deep, private personal relationship that transcends business. We communicate frequently and his position on the involvement in 'Ghostbusters 3' has been made clear and I respect that.?

?Nevertheless, Aykroyd continues on his quest, hinting he will be pursuing alternative actors to fill the shoes.

?Tough to say what a Ghostbusters movie would be like without Murray.?Not all fans are thrilled.

?Leave Ghostbusters in the past where it belongs, with its reputation maintained by affectionate nostalgia,? writes Belfast Boy on Empire's comment page. ?The legacy can only be tarnished by a much belated continuation.?

?Others see the humor in the situation or wouldn?t mind a return of the plot, if the right pieces were in place.
